What is a PSA?

A Planning Scheme Amendment is a change to the relevant Planning Scheme (in this instance the Yarra Ranges Planning Scheme) to apply a specific planning control to remove the need for separate planning permits. 

This process is commonly used for infrastructure projects and has been used for previous level crossing removal projects in Melbourne. 

The preferred design for Maroondah Highway, Lilydale is to remove the level crossing by building rail bridge over the road. Before works start the Level Crossing Removal Project (LXRP) will make a request to the Minister for Planning to amend the Yarra Ranges Planning Scheme. 

The proposed amendment incorporates site specific controls via an incorporated document, meaning the project can progress without the need for additional planning permits, subject to conditions being met to the satisfaction of the Minister for Planning. The conditions may include aspects such as local heritage, and environmental management.

What does the Planning Scheme Amendment apply to?

Most of the works taking place to remove the level crossing at Maroondah Highway do not need a planning permit and can occur without amending the Yarra Ranges Planning Scheme.

The proposed Planning Scheme Amendment will mainly apply to land within the rail corridor as well as any land temporarily required for construction, car parking and access to the rail corridor.

Why do we need to submit a Planning Scheme Amendment request?

While most of the construction will occur within the existing rail corridor and is consistent with the existing zoning of the land, there are some areas in the project area which require a planning permit (i.e. Heritage and Special Building Overlays).

 As such, the project will request an amendment to the Yarra Ranges Planning Scheme to remove these planning permit requirements.

Why are we seeking submissions?

As part of the process, the community and other interested parties have an opportunity to provide feedback or raise issues about the project. 

A summary of submissions and feedback received will be provided to the Minister for Planning as part of the formal request for approval of the Planning Scheme Amendment.

How is this different to the community consultation process?

Submissions for the Planning Scheme Amendment form part of the request to the Minister for Planning to amend the Maroondah Planning Scheme and the Yarra Ranges Planning Scheme.

In addition to the Planning Scheme Amendment, the LXRP will continue seeking feedback from the community on broader aspects of the projects. 

This feedback will help the project teams better understand what is important to the community and what is important to consider as part of the projects. It may include consultation on architectural features, walking and cycling connections and landscaping.

Who can make a submission?

Local residents and interested parties can make a submission. Major stakeholders in the area such as Yarra Ranges Shire Council, VicRoads and Melbourne Water have had an opportunity to provide input on the amendment.

What could submissions be about?

Submissions may outline concerns about, or support for, any aspect of the project or the proposed Planning Scheme Amendment. 

This can include amenity considerations, management or mitigation measures for any impacts identified or any other matters relevant to the project or the draft incorporated document.

Submissions close at 5:00pm on Monday 7 October 2019.

Does the Planning Scheme Amendment apply to heritage sites or assets?

The Planning Scheme Amendment, if approved, would not provide approval for works affecting State heritage listed sites or assets. Any change to a site or asset on the State Heritage Register requires a permit from Heritage Victoria.

If there are any proposed changes to Lilydale Railway Station as part of the project, a heritage permit application or exemption for a permit will be submitted to Heritage Victoria for approval.
